| 2011 Judge Assignment Order **May change without notice or correction here - call the clerk before you rely on this information (815) 740-8015 December 2010 Original Order (link to PDF) January 2011 Amended Order (link to PDF) IN THE CIRCUIT COURT OF THE TWELFTH JUDICIAL CIRCUIT WILL COUNTY, ILLINOIS ASSIGNMENT ORDER This Order is effective January 3, 2011. The following Judges are assigned to the following divisions at the times herein indicated: DIVISION 1: CRIMINAL FELONIES: Circuit Judge Richard C. Schoenstedt, Presiding All cases within this division are transferable between the judges assigned without written assignment order by the Chief Judge, and all cases wherein substitutions or recusals may occur will be reassigned by the Presiding Judge without having to be referred to the Chief Judge. (A): Circuit Judges Richard C. Schoenstedt (Courtroom 405), Amy M. Bertani- Tomczak (Courtroom 404), Carla J. Alessio Policandriotes (Courtroom 407), Daniel J. Rozak (Courtroom 406), Sarah F. Jones (Courtroom 402) and Associate Judge Edward A. Burmila (Courtroom 403) are assigned to hear Felony Division Court calls. It is contemplated that Judges Schoenstedt, Bertani-Tomczak, Jones, Policandriotes, Rozak and Burmila will each have a regular daily Court call, including motions on cases assigned to them. All Criminal Felony calls shall start at 9:30 a.m., Monday through Friday. Felony arraignments and preliminary hearings will be heard at 9:00 a.m. in Courtroom 405 Monday through Friday. All Drug Court referrals will be referred to Judge Policandriotes for assignment in Courtroom 407 at 1:30 p.m. on Thursday. (B): CASES BROUGHT UNDER THE ILLINOIS POST CONVICTION ACT will be brought to the attention of the Presiding Judge of the Criminal Felony Division within twenty-four (24) hours of filing. The Presiding Judge will assign them to the original trial judge or, if that is not possible, to some other judge in the Criminal Felony Division. DIVISION 2: CIVIL: Circuit Judge Susan T. O'Leary, Presiding All cases within this division are transferable between the judges assigned without written assignment order by the Chief Judge, and all cases wherein substitutions or recusals may occur will be reassigned by the Presiding Judge without having to be referred to the Chief Judge and it is contemplated that Judges O'Leary, Petrungaro, Powers, Rossi, Siegel and Mason will be able to substitute for each other on their respective Court calls when one of them is not available without written Assignment Order by the Chief Judge. The Presiding Judge may, as she deems necessary, rotate the assignment and length of the assignment of judges within her division. (A): CIVIL JURY: Circuit Judges Susan T. O'Leary, (Courtroom 227, Will CountyCourt Annex, (Annex), 57 N. Ottawa St., Joliet), Michael J. Powers (Annex 311), Raymond E. Rossi (Courtroom 401, Will County Courthouse), Richard J. Siegel (Annex 129) and Associate Judge Rick A. Mason (Annex 117). Judge Powers is assigned to hear pretrial conferences (Monday, Wednesday and Thursday). Judge Powers is assigned to hear motions on Law Jury cases. The Civil Motion call shall begin at 9:00 a.m. Monday through Friday at Annex 311. Judge O’Leary will assign cases for trial within the division on Friday at 9:00 a.m. at Annex 227. Jury Trials shall commence at 9:00a.m. (B): LAW NON-JURY OVER $50,000, CHANCERY, MISCELLANEOUS REMEDY (OTHER THAN FILINGS OF THE RESIDENTS OF THE ILLINOIS DEPARTMENT OF CORRECTIONS AND CASES BROUGHT UNDER THE DOMESTIC VIOLENCE ACT) AND TAX CASES: Circuit Judge Bobbi N. Petrungaro (Annex 236). Motions will be heard at 9:00 a.m. Trials will be scheduled daily at 10:00 a.m. and are to be set on motion. The Court will schedule pretrial settlement conferences daily at 10:30 a.m. and 1:30 p.m. and at such other times that are available. Mortgage Foreclosure cases will be heard by Circuit Judge Richard J. Siegel (Annex 129) and scheduled as follows: all mortgage foreclosures brought by Pierce and Associates: Tuesday at 1:30 p.m.; all mortgage foreclosures brought by Dutton, Olswang and Freedman law firms: Wednesday at 9:30 a.m.; all mortgage foreclosures brought by Codilis and Associates: Wednesday at 1:30 p.m.; all mortgage foreclosures brought by Fisher and Shapiro and Ira Nevel and Associates: Thursday at 1:30 p.m. Motions filed by Pierce and Associates seeking confirmation of Sheriff’s Sales shall be heard on the second Friday of each month at 9:30 a.m. Motions filed by Codilis and Associates seeking confirmation of Sheriff’s Sales shall be heard on the third Friday of each month at 9:30 a.m. No other matters are to be scheduled or accepted for hearing at these times on these dates. All other mortgage foreclosure actions will be scheduled as follows: Tuesday at 9:30 a.m. motions. (C): ARBITRATION (ARBITRATION ELIGIBLE CIVIL FILINGS BETWEEN $10,000 AND $50,000: Associate Judge Rick A. Mason (Annex 117) is assigned Supervising Judge and shall hear all matters relating to Mandatory Arbitration in Courtroom 117 at 1:00 p.m. (D): PROBATE, ADOPTION, TRUANCY AND DRUG COURT: Circuit Judge J. Jeffrey Allen (Courtroom 2, River Valley Justice Center, (River Valley), 3200 W. McDonough St., Joliet). The Probate call will be heard Monday through Friday at 9:00 a.m. Hearings will be heard Tuesday through Friday at 1:30 p.m. Adoptions will be heard every Monday at 1:30 p.m. Truancies will be heard on the third Monday of each month at 2: 30 p.m. Drug Court will be heard on the first Wednesday of each month at 3:00 p.m. All cases on this call are transferable between Judges Allen and Gomora without written Assignment Order by the Chief Judge. (E): MENTAL HEALTH HEARINGS: Associate Judge Marilee Viola. Cases set for status are held Thursday at 9:00 a.m. in Courtroom 313. Hearings are held on Friday at 9:00 a.m. at Provena Saint Joseph Medical Center or Silver Cross Hospital. (F): SMALL CLAIMS (ALL SUPPLEMENTAL CIVIL PROCEEDINGS, i.e., WAGE DEDUCTIONS, GARNISHMENTS, ETC.: Associate Judge M. Thomas Carney (Courtroom 111). Small Claims shall start at 9:00 a.m., Monday through Friday. Motions shall be heard at 10:30 a. m., Monday through Friday. Trials shall be heard at 1:30 p.m. Monday through Friday. All returns in Forcible Entry & Detainer cases are returnable at 9:00 a.m., Monday through Friday, and set for trial as determined by Judge Carney. DIVISION 3: JUVENILE DELINQUENCY/JUVENILE ABUSE AND NEGLECT CASES: Circuit Judge Paula A. Gomora, Presiding (Courtroom 1, River Valley). Juvenile Court shall start at 9:00 a.m., Monday through Friday. Delinquency hearings will be heard Monday, Wednesday and Friday at 9:00 a.m. Abuse and neglect cases will be heard Tuesday and Thursday at 9:00 a.m. Abuse and neglect permanency hearings will be heard Tuesday and Thursday at 11:00 a.m. with the exception of the following dates: January 4, January 11, January 18, February 8, February 15, February 22, March 1, March 15, March 22, April 5, April 12, April 26, May 10, May 17, May 24, June 14, June 21, June 28, July 5, July 12, July 26, August 9, August 23, August 30, September 6, September 13, September 20, October 4, October 11, October 25, November 8, November 15, November 29, December 6, December 13 and December 20. On said dates, the abuse and neglect permanency hearings will be heard at 1:30 p.m. All cases on this call are transferable between Judges Gomora and Allen without written Assignment Order by the Chief Judge. DIVISION 4: MISDEMEANOR JURY CALL, BUILDING CODE ENFORCEMENT AND HOUSING COURT: Circuit Judge Robert P. Livas, Presiding All cases within this division are transferable between the judges assigned without written assignment order by the Chief Judge, and all cases wherein substitutions or recusals may occur will be reassigned by the Presiding Judge without having to be referred to the Chief Judge. The Presiding Judge may, as he deems necessary, rotate the assignment and length of the assignment of judges within his division. (A): Circuit Judges Robert P. Livas (Courtroom 302), Carmen Goodman (Courtroom 304) and Associate Judge James E. Egan (Courtroom 303) shall hear all hearings and proceedings relating to all misdemeanors and alcohol-related traffic violations, aggravated traffic offenses (including driving while license revoked, driving while license suspended, reckless driving, fleeing and eluding, and leaving the scene of an accident), and summary suspension cases. The morning calls in Courtrooms 302, 303 and 304 shall commence at 9:00 a.m. and the afternoon calls at 1:30 p.m. Trials, summary suspension hearings and related matters will be heard by Associate Judge Joseph C. Polito (Courtroom 314). The City of Joliet Housing Court call and the Will County Zoning Building Code Enforcement call shall be heard on the second and fourth Tuesday of the month at 1:30 p.m. in Courtroom 314 by Judge Polito. Mental Health Court will be heard by Judge Livas on Tuesday at 1:30 p.m. in Courtroom 302. (B): MISDEMEANOR NON JURY ARRAIGNMENTS IN MISDEMEANORS, BOND COURT, (FELONY FIRST APPEARANCE PRIOR TO INDICTMENT OR INFORMATION), AND FELONY PRELIMINARY HEARINGS: Associate Judge Marzell L. Richardson (Courtroom 305). This call shall commence at 9:00 a.m. and all status hearings for cases disposed of by plea or guilty verdicts in Courtrooms 302, 303 and 304. In addition, bond returns and custody bond settings shall be heard in Courtroom 305 at the 1:30 p.m. call. (C): BRANCH COURTS: Associate Judge Raymond Nash. On those days when Branch Courts are not in session, the judge assigned to that call will be assigned to Courtroom 400 in the Courthouse for divorce prove-ups. Said dates are as follows: January 14, January 31, March 11, March 17, March 29, March 30, March 31, April 8, April 21, May 13, May 19, May 31, June 10, June 16, June 29, June 30, July 21, July 29, August 12, August 29, August 31, September 15, September 29, September 30, October 20, October 31, November 30, December 9, December 15 and December 30. (D): TRAFFIC: Associate Judge Lawrence C. Gray (Courtroom 121). Regular traffic calls shall commence at 9:00 a.m. and 1:00 p.m. daily. In addition to the daily 9: 00 a.m. traffic call, a 9:30 a.m. traffic call will be scheduled on Monday, Tuesday and Thursday. Pay due matters and motions will be heard Monday through Friday at 10: 00 a.m. Overweight and other commercial traffic violation cases will be heard on the third Tuesday of each month at 1:00 p.m. Will County collection cases will be heard on the fourth Friday of each month at 1:00 p.m. (E): FILINGS OF RESIDENTS OF THE ILLINOIS DEPARTMENT OF CORRECTIONS, INCLUDING MANDAMUS, HABEAS CORPUS, MISCELLANEOUS REMEDY AND LAW CASES: Associate Judge Marzell L. Richardson (Courtroom 305). The filings of residents of the Illinois Department of Corrections call shall take place at 10:30 a.m. on the fourth Thursday of the month and at 10:30 a.m. on the second Friday of the month. (F): CIVIL ASSET FORFEITURES: Associate Judge Joseph C. Polito (Courtroom 314); or, as determined by the Judges within the division. This call will be heard on the following dates: January 10, January 24, February 14, February 28, March 14, March 28, April 11, April 25, May 9, May 23, June 13, June 27, July 11, July 25, August 8, August 22, September 12, September 26, October 17, October 24, November 14, November 28, December 12 and December 19. For return purposes, all returns should be made to Courtroom 314. DIVISION 5: FAMILY: Associate Judge Robert J. Baron, Presiding All cases within this division are transferable between the judges assigned without written assignment order by the Chief Judge, and all cases wherein substitutions or recusals may occur will be reassigned by the Presiding Judge without having to be referred to the Chief Judge. The Presiding Judge may, as he deems necessary, rotate the assignment and length of the assignment of judges within his division. (A): DISSOLUTION OF MARRIAGE. DECLARATION OF INVALIDITY OF MARRIAGE. CHILD CUSTODY PROCEEDINGS AND ALL POST DECREE MATTERS ARISING FROM THE ABOVE CASES: Circuit Judge John C. Anderson (Courtroom 301), Associate Judges Dinah L. Archambeault (Courtroom 300), Robert J. Baron, Presiding, (Courtroom 312), Bennett J. Braun (Courtroom 306) and Robert P. Brumund (Courtroom 307). Motions, case management conferences, status calls, prove-ups, grounds hearings, status hearings and contested pre and post decree motions shall be heard Monday through Friday mornings. Trials involving remaining issues, custody, visitation, removals and post decree matters requiring extended testimony shall be heard at 1: 30 p.m. Monday through Thursday. Pretrials shall be heard at 1:30 p.m. on Friday and at such other times as are scheduled by the Court. (B): PATERNITY, NON-SUPPORT AND RELATED MATTERS PROSECUTED BY THE ILLINOIS ATTORNEY GENERAL'S OFFICE: Associate Judge Matthew G. Bertani (Courtroom 308) will hear the Attorney General Support Enforcement calls on Monday, Tuesday, Thursday and Friday at 9:00 a.m. in Courtroom 301. (C): STATE'S ATTORNEY SUPPORT ENFORCEMENT CALL: Associate Judge Matthew G. Bertani (Courtroom 301) will hear the State's Attorney Support Enforcement call on Wednesday at 9:00 a.m. in Courtroom 308. (D): DOMESTIC VIOLENCE COURT, ORDERS OF PROTECTION: Associate Judge Marilee Viola (Courtroom 313). Emergency Orders of Protection will be heard at all times when Court is in session. Plenary Orders and extensions of Emergency Orders will be heard Monday through Friday at 9:00 a.m. Criminal Misdemeanor Domestic Violence cases will be heard Monday through Friday at 1:30 p.m. It is understood that persons may apply for Orders of Protection at any time that Court is in session. (E): FAMILY MATTERS ORIGINATING FROM THE ILLINOIS DEPARTMENT OF CORRECTIONS: Associate Judge Matthew G. Bertani (Courtroom 308). Filings of dissolution of marriage by residents of the Illinois Department of Corrections. FLOATER: Will be assigned when the vacancies currently existing in the Office of Associate Judge are filled.
